Leadership Surge (Lead to People) SMS Messaging Services

Welcome to Leadership Surge. These Terms and Conditions (“Terms”) govern your enrollment in and use of Leadership Surge’s SMS-based leadership development and training services (the “Service”). By subscribing to or otherwise using our SMS messaging service, you agree to be bound by these Terms, as well as our Privacy Policy (the “Privacy Policy”). If you do not agree to these Terms, do not use or access the Service.

1. Service Description

1.1 Overview. Leadership Surge provides SMS-based leadership training content and notifications (“the Service”) to subscribed users. The content is personalized based on each user’s organizational role (e.g., senior leader, supervisor, or front-line employee) and personality profile (e.g., Blue, Green, Gold, or Orange).
1.2 Types of Messages. By subscribing, you may receive:

  • Short, TikTok-style leadership video links (where applicable)
  • Personalized learning modules and reminders
  • Engagement check-ins and progress prompts
  • Course completion notifications
  • Follow-up messages based on prior interactions

2. Consent and Enrollment

2.1 Consent. By enrolling in Leadership Surge’s SMS messaging service, you explicitly consent to receive automated text messages from Leadership Surge at the mobile number you provide. Your consent to receive these messages is not a condition of purchase.
2.2 Frequency. Message frequency varies based on your role, personality profile, and engagement level. You may receive more or fewer messages depending on how you interact with the Service.

3. Opt-Out Instructions

3.1 Opt-Out. You may opt-out at any time by replying “STOP” to any Leadership Surge message. After opting out, you will receive one final message confirming your unsubscription. No further messages will be sent unless you re-subscribe.
3.2 Re-Subscribe. To resume messages, reply “START” to any previous conversation thread with Leadership Surge or resubscribe through the original enrollment method.

4. Message and Data Rates

4.1 Carrier Charges. Standard text message and data rates may apply to each message sent or received as determined by your wireless service plan. Contact your wireless carrier for information about your plan’s specifics.
4.2 Additional Charges. Your carrier may impose additional messaging or data charges that are beyond our control.

5. Supported Carriers

5.1 Major U.S. Carriers. This service is available through most major U.S. wireless carriers. However, availability may vary.
5.2 No Guarantee. Leadership Surge does not guarantee delivery of messages and is not responsible for any delays or errors caused by carrier or technical issues.

6. Privacy and Data Usage

6.1 Personal Data. We collect and use your mobile number, personality profile, role information, and response data to personalize your leadership development journey. All collection and use of personal information is governed by our Privacy Policy.

7.2 Interactive Lessons. Future lessons may be adapted based on your prior responses, ensuring that your development path remains engaging and relevant.
7.3 Non-Promotional. We do not send unrelated promotional materials through this SMS service. Messages strictly pertain to leadership development and training.

8. User Responsibilities

8.1 Compliance with Terms. You agree to comply with these Terms and to use the Service only for lawful and legitimate purposes.
8.2 Updating Contact Information. You are responsible for ensuring the mobile number you provide is valid and current, and for any fees charged by your carrier.
8.3 Appropriate Use. You agree not to misuse the Service, including sending harassing, threatening, or unlawful content in response to messages.
8.4 Age Restriction. Users must be at least 18 years old to participate in the Service. By enrolling, you represent and warrant that you meet this requirement.

11. Limitations of Liability

11.1 Indirect Damages. Leadership Surge AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
11.2 Total Liability. IN NO EVENT WILL Leadership Surge’S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID (IF ANY) FOR THE SERVICE DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
11.3 Service Interruptions. Leadership Surge is not liable for delayed, lost, or misdirected messages, or any interruption of the Service due to reasons beyond our reasonable control.

12. Geographic Restrictions

12.1 U.S. Only. The Service is currently offered only within the United States and its territories. If you access or use the Service from outside the U.S., you do so at your own risk and are responsible for compliance with local laws.

13. Changes to Terms

13.1 Right to Modify. Leadership Surge reserves the right to modify these Terms at any time and for any reason.
13.2 Notification. Material changes will be communicated to users via SMS and/or email. Your continued use of the Service after the effective date of any changes indicates your acceptance of the modified Terms.

14. Termination

14.1 Termination by Leadership Surge. Leadership Surge may terminate your access to the Service at any time for violation of these Terms, misuse of the Service, or any other lawful reason.
14.2 Effect of Termination. Upon termination, you will no longer receive SMS messages. Any rights or liabilities that have accrued prior to termination remain unaffected.

15. Governing Law and Dispute Resolution

15.1 Governing Law. These Terms are governed by and construed under the laws of the State of [State], without regard to its conflict of law principles.
15.2 Dispute Resolution.
